Terms of service

These terms govern your use of McPortal. By creating an account or using the service, you agree to them.
1. Service
McPortal (“the Service”) is provided by Orche Strategies (“we”, “us”), located in California, USA. The Service lets you configure and host MCP servers, connect third-party integrations, and grant your team access to tools.
2. Account
You are responsible for keeping your sign-in method secure and for all activity under your account. You must be at least 18 years old to create an account on behalf of an organization. Provide accurate information when registering and keep it up to date.
3. Acceptable use
You agree not to use the Service to:
- Violate any law, or any third party’s rights, including intellectual property rights.
- Abuse, overwhelm, or exfiltrate data from connected provider APIs (Slack, GitHub, Google, etc.) in a way that violates those providers’ terms.
- Bypass or undermine the Service’s permission, audit, or rate-limit controls.
- Send spam, phishing, malware, or other harmful content through the Service.
- Probe or scan the Service for vulnerabilities outside our responsible disclosure process.
- Resell, white-label, or sublicense the Service without a separate written agreement.
4. Subscription, billing, and trial
The Service is offered at $3 per user per month, billed monthly through Stripe. New accounts include a 7-day free trial; we do not charge until the trial ends. You can cancel at any time through the Stripe customer portal linked from your dashboard. Cancellation takes effect at the end of the current billing period; we do not pro-rate refunds for unused time except where required by law.
We may change pricing on at least 30 days’ notice. If you do not accept a price change you may cancel before it takes effect.
5. Customer data
You own your data. We process it solely to operate the Service for you. We do not sell customer data, and we do not use it to train machine learning models. See our privacy policy for the full picture.
6. Data protection
Where the Service processes personal data on your behalf, we act as a data processor (and you as the controller) under GDPR Art. 28 and equivalent laws. Our Data Processing Agreement is available on request and, once executed, is incorporated into and forms part of these Terms with respect to that processing. The DPA controls in the event of a conflict between these Terms and the DPA on data-protection matters.
7. Confidentiality
We treat your account, configuration, and audit data as confidential. We will not disclose it to third parties except: to subprocessors needed to run the Service (listed in our privacy policy), when you instruct us to, or when required by law. We will give you notice of any legal demand for your data unless we are prohibited from doing so.
8. Service availability
We work to keep the Service available but do not offer a formal SLA at this tier. Maintenance windows, third-party outages (Cloudflare, Neon, the providers you connect), and unforeseen incidents may cause interruption. Enterprise customers may negotiate an SLA in a separate written agreement.
9. Termination
You may terminate your account at any time by canceling your subscription and emailing legal@orchestrategies.com to delete your data. We may suspend or terminate accounts that violate these terms, generally with prior notice unless the violation requires immediate action. After termination, we will delete your data within a reasonable period, except where retention is required by law.
10. Disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements.
11. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising from these terms or your use of the Service. Our total aggregate liability for any claim arising out of these terms or the Service will not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim.
12. Indemnity
You will defend and indemnify us against any third-party claim arising from your data, your use of the Service in violation of these terms, or your violation of a third party’s rights or applicable law.
13. Governing law and venue
These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state and federal courts located in San Francisco County, California, and each party consents to personal jurisdiction there.
14. Changes to these terms
We may update these terms. For material changes, we will update the “last updated” date and notify account owners by email at least 30 days before they take effect, except where a shorter period is required by law. Continued use of the Service after the effective date constitutes acceptance.
